Neighborhood Restrictions
Hidden Valley Subdivision and Hidden Valley Subdivision No.2
The owner declares that the aforesaid lots are held and shall be conveyed subject to the building and use restrictions herein set forth:
1. Any dwelling erected on this lot shall have the following minimum square foot requirements:
Ranch style – 800 sq. ft.; 1 1/2 and 2 story style – 700 sq. ft. on ground floor; all Multi-level styles – 800 sq. ft. on main floor. This shall encompass total living space, exclusive of porches, patios, terraces, basements or garages.
2. No mobile homes shall be permitted on these lots.
3. All construction shall be of new materials. No used buildings from other locations shall be moved and located on these lots.
4. No open storage shall be permitted on these lots except during periods of construction.
5. The exterior of all buildings shall be completed within twelve (12) months from the date the building permit is issued.
6. No pigs, or any commercial raising of farm or domestic animals shall be allowed on these lots.
7. All detached garages and out-buildings shall have the same exterior finish and color as the residence.
8. Any fencing shall be constructed of wood, vinyl or chain link with standard metal posts and top rail and shall not extend forward beyond the front edge of the residence.
9. A split-rail or other decorative type fence (no restraining type fence) may be constructed in front of the residence.
10. Any boat, camper, trailer, motor home, semi-tractor etc., shall be stored inside garage or behind building set-back lines.
11. Subdivision owners shall approve all initial exterior paint colors prior to application.
12. The City of Topeka Regulations and Ordinances shall apply to all lots.
All restrictions herein set forth shall continue and be binding upon the owners and upon their successors and assigns for a period of twenty-five (25) years from November 1,2002.
The restrictions herein set forth shall run with the land and bind the owners, their successors and assigns; and the vested owner or owners of any of the above land shall have the right to sue for and obtain an injunction, either prohibitive or mandatory, to prevent the breach of or to enforce the observance of the restrictions above as set forth.
